Why search first

A search costs less than a mistake.

Trademark offices compare a new application with the marks that are already on their register. If yours is too close to an earlier mark, the office can refuse it, or the owner of the earlier mark can object. In many offices the official fee is not returned when an application is refused.

The bigger cost comes after launch. A name that has to change once the packaging is printed, the website is live and customers know you is far more expensive than any search.

A search lets you find out early which of those paths you are on: the name is clear, the name needs a small change, or it is better to pick another one while that is still cheap.

A search lowers risk. It cannot remove it. Very recent applications may not show in the registers yet, and a business may be using a name without having registered it.

How long does a search take?

It depends on the level and on how many countries you choose. We tell you the expected time in our reply, before you agree to anything.

What if you find a conflict?

We explain what the conflict is and how serious we think it is. You can then change the name, narrow the goods and services, go ahead anyway knowing the risk, or choose another name.

Do I need a search before registering?

Most offices do not require one, but we recommend it. It is much easier to change a name before it is filed than after.

Is the search included in the filing fee?

It is quoted separately. If you want both a search and a registration, tell us and we will quote them together.

Which registers do you check?

The official trademark registers of the countries you choose. We confirm the exact list in our reply.
