Trademark Assignment

When a mark is sold, merged or moved to another company, the registers need to say so. We take care of that.

What an assignment is

An assignment transfers ownership of a trademark, or of a pending application, from one owner to another. It happens in sales of a business or a brand, in company reorganisations, and when a founder moves a mark into a new company.

The agreement between the parties is one thing. The official record is another. Until the trademark office has recorded the new owner, third parties and the office itself may keep treating the old owner as the holder, which can cause trouble at renewal or when the mark is relied on.

What is included

  • Listing exactly which marks, in which countries, are being transferred
  • Preparing the assignment document, or reviewing the one you already have for what the offices need
  • Telling you how each office wants the document signed
  • Recording the change at each office
  • Confirming the updated record to you when it is done

How it works

  1. Send us the detailsWho is giving up the mark, who is taking it, and which marks and countries are involved.
  2. The documentWe prepare it, or check yours, so that it will be accepted.
  3. SigningThe parties sign in the way the offices require.
  4. RecordingWe file the request at each office.
  5. ConfirmationYou receive the updated record.

The commercial terms of a sale are for the parties to agree, with their own advisers. We handle the trademark side: the document the offices need and the register entries.
